Acceptance of Terms

The services that the Osteopathic Cranial Academy (OCA) provides to you are subject to the following Terms & Conditions. The OCA reserves the right in its discretion to update the Terms & Conditions at any time without notice to you. We will post notice of those changes, and the date that they became effective, on CranialAcademy.org.

Description of Services

The OCA provides you with access to a variety of internet-based resources, including shopping, dues payment, newsletters, and information (collectively “Services”). The Services, including any updates, enhancements, new features, and/or the addition of any new Web properties, are the sole property of the OCA and subject to the Terms & Conditions.

Membership

Membership payments are for the current calendar year and are non-refundable. For more information on Members benefits see www.cranialacademy.org/membership/benefits/.

Applications for membership are accepted online but applicants must meet all requirements for membership to be accepted. For more information on membership requirements, see www.cranialacademy.org/membership/

Refund Policy

Except where otherwise noted here, all sales are final; we do not provide refunds. Please consider your purchases carefully.

If you register for a course and do not meet the eligibility requirements for it, your tuition payment will be refunded, minus a $25 processing fee. If you have any questions about your eligibility, please contact the OCA office before registering.

Book and brochure orders may be cancelled with the office prior to shipping, minus a $25 handling fee. Once an order has been shipped, the sale is final.

Course cancellations at least 14 days in advance may be refundable, if there is a waiting list and the registrant can be replaced in the course. Meal tickets are nonrefundable, and there is no discount for not attending food functions covered by the main registration fee.

Personal and Non-Commercial Use Limitations

Unless otherwise specified, the Services are for your personal and non-commercial use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Services without the explicit written permission of the OCA.

Use of Website

This site is in no way intended to serve as a substitute for medical diagnosis or treatment. Data contained on or made available through our website is not intended to be, and does not constitute, medical or health advice. Our website, and your use of it, does not create a physician-patient relationship. We do not warrant or guarantee the accuracy, adequacy, or recency of the data contained in or linked to our website. You should not act or depend on any data on our website, where applicable, without seeking the counsel of a competent physician licensed to practice in your jurisdiction for your particular medical issues.

Third Party Content

CranialAcademy.org contains information provided by third parties. The site also provides links to other websites. Although the OCA uses protocols and review processes for the content we post on CranialAcademy.org, we assume no responsibility for information provided by third parties or the content of other Internet sites to which we provide links. The OCA is providing these links to you only as a convenience, and the inclusion of any link does not imply endorsement by the OCA.

The OCA has taken reasonable measures to ensure that the information contained within CranialAcademy.org is reliable, however, by using this website, you accept that the information, products and services provided here are “AS IS.” OCA makes no express or implied warranty regarding the accuracy, content, completeness, reliability, operability, or legality of information contained within the site, including, without limitation, the warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.

Intellectual Property

Copyright, trademark, and other intellectual property laws apply to the materials on CranialAcademy.org

You may not modify, copy, reproduce, republish, upload, post, transmit, or distribute, in any manner, the content on our website, including text, graphics, code and/or software.

You may not sell or modify the content or reproduce, display, publicly perform, distribute, or otherwise use the content in any way for any public or commercial purpose. If you violate any of the terms or conditions, your permission to use the content automatically terminates and you must immediately destroy any copies you have made of the content.

You are granted a nonexclusive, nontransferable, revocable license to use our website only for private, personal, noncommercial reasons. You may print and download portions of material from the different areas of the website solely for your own noncommercial use, provided that you agree not to change the content from its original form. Moreover, you agree not to modify or delete any copyright or proprietary notices from the materials you print or download. Also note that any notice on any portion of our website that forbids printing & downloading trumps all prior statements and controls.

Member Account, Password and Security

If we provide you with a user ID (username) and password to enable you to access restricted areas of our website or other content or services, you must ensure that that user ID and password is kept confidential. You may not share your user ID and/or password with anyone for any reason, either directly or indirectly. You accept responsibility for all activities that occur under your user ID or password.

We may disable your user ID and password at our sole discretion or if you breach any of the policies or terms governing your use of this website or any other contractual obligation you owe to us.

You agree to notify the OCA immediately of any unauthorized use of your account or any other breach of security. The OCA will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by the OCA or another party due to someone else using your account or password. You may not use anyone else’s account at any time, without the permission of the account holder.

No Unlawful or Prohibited Use

As a condition of your use of the Services, you will not use the Services for any purpose that is unlawful or prohibited by these terms, conditions, and notices. You may not use the Services in any manner that could damage, disable, overburden, or impair any AAO server, or the network(s) connected to any AAO server, or interfere with any other party’s use and enjoyment of any Services. You may not attempt to gain unauthorized access to any Services, other accounts, computer systems or networks connected to any The AAO server or to any of the Services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Services.

Choice of Law and Forum. This Agreement is entered into and performed in the State of Indiana, United States of America, and is governed by the laws of Indiana, exclusive of its choice of law or conflict of laws provisions. In any claim or action directly or indirectly arising under this Agreement or related to CranialAcademy.org, each party irrevocably submits to the exclusive personal jurisdiction of the Circuit Court of Cook County, or if such court does not have subject matter jurisdiction, then each party irrevocably submits to the exclusive personal jurisdiction of the United States District Court for the Northern District of Illinois, and whichever of those two courts has jurisdiction, each party waives any jurisdictional, venue, or inconvenient forum objections to such court.

Complete Agreement

If any provision or provisions of this Agreement are held by a court or other tribunal of competent jurisdiction not to be enforceable, then such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. This Agreement constitutes the entire agreement between the parties pertaining to its subject matter and supersedes any earlier agreements, memoranda, or understandings. It may not be modified except as described elsewhere in this Agreement. Anything in the CranialAcademy.org program inconsistent with or conflicting with the terms of this Agreement is superseded by the terms of this Agreement.

Find-A-Physician

The OCA membership list is compiled and published as a reference source of member information. Entries in the membership list are based on information reported to the OCA by members and do not come from, nor have they been been verified with, primary sources. Additionally, the data may have been changed without the OCA being informed. Consequently, because of the possibility of reporting errors and delays in processing information, the accuracy and completeness of the physician data in this membership list cannot be guaranteed. Additionally, this membership list is not recognized by any national accrediting organization as a primary data source for physicians’ credentials verification. Members are encouraged and permitted to view their database listings and to update them whenever appropriate.

The OCA disclaims any and all warranties, whether express or implied, as to the accuracy, completeness or timeliness of the information contained in this membership list. In no event shall the OCA be liable to you or anyone else for any decision made or action taken by you in reliance on the data in this membership list.

The membership list is the sole property of the OCA. The membership list and the data comprising it may not be downloaded, republished, resold or duplicated, in whole or in part, for any purpose including – without limitation – compiling mailing lists or any other lists of osteopathic physicians.
